Terms of Use

1. Scope and provider

These Terms of Use govern your use of the "Klebster" service at klebster.com (the "Service"). The provider is:

2. What the Service is

Klebster is a free game in which physical stickers are placed in the real world and searched for and found by other people. The Service provides a map, a location check, and the ability to register stickers with a photo, description and hiding-place hint, and to organise them into "series".

The Service is provided free of charge, with no guarantee of availability, completeness or continued existence. There is no entitlement to use it. We may change, restrict or discontinue features at any time.

You may only upload content you hold the necessary rights to. For photos in particular:

You warrant that you hold all necessary rights and consents, and you will indemnify the provider against third-party claims arising from content you uploaded, including reasonable legal defence costs.

6.2 Rights you grant us

You retain the rights to your content. You grant the provider a non-exclusive, worldwide, royalty-free licence, limited to operating the Service, to store your content, process it technically (for example stripping metadata or adjusting format) and display it to other users as part of the game's features. We will not use it for advertising or pass it on for unrelated purposes. The licence ends when the content is deleted, except where it is retained in anonymised form under section 8.

6.3 Visibility

Please be aware that by placing a sticker you make its location and photo available to other users. The photo of a placed sticker is retrievable only by people who have found it; a series' reference photo is public. See the Privacy Policy for details.

In case of violations we may remove content, disable features, and permanently block access. Further claims remain reserved.

8. Account, deletion and termination

You can delete your account at any time on the Account page. This deletes your personal data and your photos; placed stickers, finds and series are retained in anonymised form, because they represent shared game state belonging to other users. See the Privacy Policy, section 6, for details.

We may terminate the user relationship at any time with reasonable notice, and without notice in case of serious violations.

9. Liability

The provider is liable without limitation for intent and gross negligence, for fraudulent concealment of defects, where a guarantee has been given, and for damage arising from injury to life, body or health. Liability under product liability law remains unaffected.

For ordinary negligence, the provider is liable only for breach of a material contractual obligation (an obligation whose fulfilment makes proper performance possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of agreement. Liability is otherwise excluded.

As this is a free service, no warranty is given in particular for continuous availability, the accuracy of displayed locations, the preservation of stored data, or content posted by other users. We accept no responsibility for third-party content such as map imagery or linked sites.

10. Changes to these Terms

We may amend these Terms, for example when features change or the legal situation changes. The current version is always available on this page; the date at the top shows its status. By continuing to use the Service after a change, you accept the new version. If you do not agree, you can stop using the Service and delete your account.

11. Final provisions

German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence (Art. 6 Rome I Regulation).

The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
